The following terms and conditions apply to products purchased from SodSuppliers.com, hereinafter referred to as “Sod Suppliers.” The purchaser, website visitor or other person placing or accessing an order shall hereinafter be referred to as the “Customer.”
Sod Suppliers provides customers access to SodSuppliers.com and its ordering services subject to the terms and conditions set forth below, together with any policies, documents and guidelines incorporated by reference.
Customer responsibilities when placing an order, accepting delivery and reporting product or delivery concerns.
Customer is responsible for providing complete and accurate information as to quantities ordered, delivery location and method of payment. Customer is solely responsible for any errors or delays in delivery caused by incorrect information provided by Customer.
All deliveries will be made to the property line where it meets public access at the address provided by Customer. Delivery is not guaranteed to specific areas of the property. The location of all deliveries shall be at the sole discretion of SodSuppliers.com. If the Customer requests delivery on the property, delivery on the property will be made solely at the discretion of SodSuppliers.com and based on the ability of the driver to safely do so. SodSuppliers.com will not be liable for any damage to any property that occurs during delivery including, but not limited to, tire ruts, cracked irrigation lines, damaged fences or cracked pavement. The final decision as to whether to make an on-property delivery will be in the sole discretion of SodSuppliers.com after the driver has seen the property and the requested delivery position. Sales are final and sod may not be returned if the driver determines it is unsafe for an “on-property” delivery, in which case the sod will be delivered and set at the property line on public access.
All sod must be placed and installed within 24 hours of delivery and properly maintained by Customer.
Sod may only be returned with SodSuppliers.com consent. Sod may only be returned within 24 hours of delivery and then only if the sod has not been disturbed or removed from the pallet.
Customer must report any delivery or quality issues, including shortages, to SodSuppliers.com within 24 hours of delivery of sod.
Responsibilities relating to installation, watering, site preparation and lawn-treatment products.
SodSuppliers.com does not perform or offer installation services and therefore does not warrant against installation issues, including but not limited to improper installation, lack of water, improper site preparation, over-fertilization, negligent installation or acts of God. Customer is solely responsible for proper installation and maintenance of all sod.
Applications of pre-emergent, post-emergent or other weed reducers or killers are done at the Customer’s risk and SodSuppliers.com shall not be responsible or liable for the results, or lack of results, of same.
Important provisions regarding claims, cancellations, weather, delivery timing, liability and shortages.
All claims and/or suits between the parties arising from the purchase of sod or otherwise related to this transaction shall be brought in Fulton County, Georgia.
Cancellations of orders, where permitted, must be made not less than two business days before the scheduled delivery date and may only be accepted at SodSuppliers.com’s sole discretion after that time.
SodSuppliers.com may cancel delivery at any time based on weather conditions. SodSuppliers.com will attempt to give at least 12 hours notice of cancellation where and when conditions permit.
Delivery times are approximate and SodSuppliers.com shall not be liable or responsible for shipping or delivery delays.
In any event, SodSuppliers.com’s liability is at all times limited to the cost of sod ordered and shall not exceed that amount. In no event shall SodSuppliers.com be liable for any indirect, direct, remote, consequential or special damages and shall not be liable for damages related to loss of profits or loss of use.
Customer shall be solely responsible for risk of loss upon shipment of any order and shall provide insurance coverage for same.
Claims for shortages must be reported immediately and verified by an independent party at the Customer’s sole expense.
Sod is a natural agricultural product. Installation conditions, seasons, sunlight, insects and weeds can affect its appearance and performance.
Installations are handled by independent contractors who are not hired by or working under the supervision of SodSuppliers.com. Any installation issues must be handled directly with the contractor and SodSuppliers.com will have no responsibility or liability for same.
SodSuppliers.com does not participate in the installation of any sod and therefore shall not be responsible for damage of any kind that occurs during the installation process.
If sod is installed out of season, SodSuppliers.com does not warrant or guarantee it will come out when its season begins.
Sod shade tolerance is approximate and SodSuppliers.com will not be responsible or liable if there is inadequate light to allow proper growth of any installation. Customer is solely responsible for verifying all site and installation conditions.
Customer acknowledges that insects and pests are a naturally occurring element in sod and other agricultural products and that SodSuppliers.com is not responsible or liable for insects or pests living in any sod before or after installation, or previously in the ground, surrounding area, dirt at the farm, installation site or otherwise.
Customer acknowledges that weeds are a naturally occurring element in sod and other agricultural products and that SodSuppliers.com is not responsible for any weeds that occur after the sod is installed or that are present in the sod but not obvious upon visual inspection.
These provisions address product warranties, payment authorization, failed payments and information required to complete an order.
All product is sold where-is, as-is, and SodSuppliers.com makes no warranties, express or implied, except as may be set forth upon the face of the order. SodSuppliers.com specifically disclaims all warranties of fitness for a particular purpose as well as all warranties of merchantability.
Customer authorizes any bank to deduct checking and/or savings payment(s) from the indicated checking and/or savings account immediately upon the submission of each order.
If a payment profile is or has been created, Customer authorizes SodSuppliers.com to charge any credit or debit card payments to Customer’s credit or debit card(s), and Customer further authorizes Customer’s bank to deduct any checking and savings payment(s) from Customer’s checking or savings account immediately upon the submission of each order.
If SodSuppliers.com is unable to secure funds from Customer’s credit or debit card(s) or Customer’s bank for any reason, including but not limited to insufficient funds in Customer’s credit or debit card or bank account, or insufficient or inaccurate information provided by Customer when submitting Customer’s electronic payment, SodSuppliers.com may undertake further collection action, including application of fees to the extent permitted by law or hereunder.
There will be a charge of $50.00 or the maximum amount allowed by law, whichever is greater, for any returned checks or dishonored payments, which shall be assessed each time a check is returned or payment dishonored.
Customer’s cooperation is essential to the proper and timely fulfillment of Customer’s order and Customer agrees to provide all information requested by SodSuppliers.com or necessary to fully complete and deliver Customer’s order.
Governing law, acceptance of these terms, website information, third-party links and other provisions applicable to the agreement.
All issues related to Customer’s order, all related transactions and the construction or application of these terms shall be determined in accordance with the laws of the State of Georgia.
By submitting an order to SodSuppliers.com, Customer acknowledges that Customer has read all terms and conditions, understands same and agrees to be bound by each.
The information and descriptions contained on SodSuppliers.com are intended as general information and are not necessarily complete descriptions. Product availability varies and is subject to verification. Description of a product or service on SodSuppliers.com does not constitute an offer to sell until availability is verified.

Customer’s order together with these Terms & Conditions constitutes the entire agreement between the parties and all prior agreements or discussions are merged herein. No agreement between the parties made prior to, during the placement of this order, or subsequent thereto shall be binding upon either party unless made in writing as an amendment to this order and these Terms & Conditions and duly signed by both parties.
The Terms & Conditions set forth herein may be changed or modified from time to time in the sole discretion of SodSuppliers.com. If changed, SodSuppliers.com will post the new Terms & Conditions on its website. Changes or modifications will be effective upon posting to the website. Customer’s accessing or using SodSuppliers.com following any changes or modifications will constitute Customer’s acceptance of all Terms & Conditions as revised.
If any provision herein is deemed unlawful, unenforceable or void, that provision shall be deemed severable and shall not affect the enforceability of the remaining Terms & Conditions.
These Terms & Conditions shall be deemed to be and construed as a part of an agreement between the parties and shall be enforceable in a court of law in the same manner as any other contract. The parties agree that these Terms & Conditions shall be admissible in any court or arbitration proceeding.
Sod is a perishable agricultural product. Delivery timing, weather, installation conditions, watering, sunlight, site preparation and maintenance can materially affect the condition and performance of sod after delivery.
Please confirm your quantity, delivery address, delivery access, installation arrangements and ability to begin watering before placing an order.
